Terms of Service

When we say "we", "us" or "Festinger's Vault / GrootMade / Festinger World" it's because that's who we are and we own and run the service located at https://grootmade.com, https://festingervault.com and https://festingerworld.com.

1. Acceptance of Terms

Festinger Vault is a digital marketplace which helps thousands of people around the world share what they purchased for expensive price and earn extra cash and most important make them affordable for others. When you create an account and accept these terms you become a member of our community. During your time with us you agree to follow the ground rules outlined in these terms so please make sure you have read, understood, and agreed to all the terms.

If you don't accept the terms then you will need to leave because your presence on and use of the site is conditional on your acceptance to be bound by these terms and the Privacy Policy whether you become a member or not.

2. Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address & information.

You represent and warrant that: you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that the information you supply to us is true, correct and complete.

The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

We don't store any payment information like bank details or card numbers in our server.

3. Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

4. Product Delivery

All our free downloadable products are available for direct download. All paid downloadable products can be downloaded as a single product. Paid products will be accessible for download after payment is received and verified. To process our payments we use Paypal, Master Card, Visa and all major credit cards. You must agree with their terms and conditions before paying for any template or theme.

Your membership information will be emailed to the email address. Normally our system creates the account after successful payment. There are some cases that your payment is not successful done and then we have to review and process download information manually. So, delays can be as long as 1 hr up to 24hrs depending on the situation and amount of investigation required after a fraud alert has been activated.

5. Returns and Refunds Policy

We do not issue refunds for digital products once the order is confirmed and the product was sent/ready to download. There is no obligation to provide a refund or credit in situations if you have changed your mind about an item, you purchased an item by mistake or you can no longer access the item because it has been removed by its author from Festinger's Vault Market (we advise you to download items as soon as you buy them to avoid this situation). We recommend contacting us for assistance if you experience any issues receiving or downloading offered products. Renewals to your account are non-refundable.

5.1. Chargebacks, Payment Disputes and User Responsibility

By making a purchase, the user confirms that they are legally authorised to use the selected payment method and that all payment, billing and account information provided is accurate, complete and up to date.

Users agree not to initiate any chargeback, payment reversal, payment dispute, refund claim or similar action with their bank, card issuer, payment provider, PayPal, Stripe or any other payment processor without first contacting Festinger's Vault and allowing Festinger's Vault a reasonable opportunity to investigate and resolve the issue.

If a user initiates a chargeback, payment reversal or payment dispute after access to the purchased digital products, downloads, membership benefits or services has been provided, Festinger's Vault reserves the right to immediately suspend or terminate the user's account, revoke access to downloads, disable membership benefits, and block future purchases, to the extent permitted by applicable law.

The user remains responsible for any unpaid amounts, reversed payments, chargeback fees, payment processor fees, administrative costs, collection costs, legal costs and other reasonable costs incurred by Festinger's Vault as a result of an unjustified, fraudulent, abusive or bad-faith chargeback, payment dispute or payment reversal.

Festinger's Vault may provide evidence to payment processors, banks, card issuers or other relevant parties to dispute a chargeback or payment reversal, including but not limited to account information, order details, IP addresses, download logs, access logs, communication records, delivery confirmation, payment records and acceptance of these Terms.

Nothing in this clause limits or excludes any statutory rights that cannot be limited or excluded under applicable consumer protection laws.

5.2. Fraudulent, Abusive or Unauthorised Payment Activity

Any fraudulent, abusive, unauthorised or unlawful payment activity is strictly prohibited. This includes, without limitation, using a payment method without authorisation, providing false billing information, creating multiple accounts to avoid payment restrictions, abusing refund or chargeback procedures, or falsely claiming that digital products or services were not delivered after access has been provided.

Festinger's Vault reserves the right to refuse, suspend, cancel or terminate any order, account, membership or access where fraud, abuse, unauthorised payment activity, excessive chargebacks or suspicious behaviour is detected or reasonably suspected.

Where Festinger's Vault suffers losses, costs, fees, penalties, damages or expenses as a result of fraudulent, abusive, unauthorised or bad-faith conduct by a user, the user agrees to indemnify and hold Festinger's Vault harmless against such losses, to the maximum extent permitted by applicable law.

5.3. Limitation of Liability

To the fullest extent permitted by applicable law, Festinger's Vault, its directors, officers, shareholders, employees, contractors, agents, affiliates and licensors shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of business, loss of goodwill, loss of data, loss of access, loss of downloads, business interruption, or any damages arising from payment disputes, chargebacks, payment reversals, account suspension, service interruption, termination of services, or inability to access digital products or services.

Festinger's Vault's total aggregate liability for any claim arising out of or relating to a purchase, membership, digital product, download, service, payment dispute, chargeback or these Terms shall, to the maximum extent permitted by applicable law, be limited to the amount actually paid by the user to Festinger's Vault for the specific purchase or membership giving rise to the claim during the three months preceding the event giving rise to liability.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability for intent, deliberate recklessness, fraud, or any mandatory consumer rights that cannot be excluded.

5.4. No Personal Liability of Directors, Officers or Shareholders

The user acknowledges and agrees that Festinger's Vault is operated through a legal entity and that any claim, dispute, chargeback, refund request, payment dispute or other matter relating to the website, platform, marketplace, digital products, memberships, downloads or services must be directed solely against the relevant contracting legal entity.

To the fullest extent permitted by applicable law, no director, officer, shareholder, employee, contractor, agent, affiliate or representative of Festinger's Vault shall be personally liable for any obligation, debt, refund, chargeback, payment dispute, damages, costs, loss or claim arising out of or relating to the user's purchase, membership, account, use of the website, access to digital products, or these Terms.

This limitation does not apply where personal liability cannot be excluded under mandatory applicable law, including in cases of fraud, intentional misconduct, deliberate recklessness or other circumstances in which applicable law imposes personal liability.

5.5. Finality of Digital Delivery

The user acknowledges that Festinger's Vault provides digital products, downloads, memberships and/or access to digital services. Once access has been granted, products have been made available for download, or membership benefits have been activated, the digital service shall be deemed delivered, subject to any mandatory rights the user may have under applicable law.

The user is responsible for downloading, storing and safeguarding any digital products made available during the active membership period. Festinger's Vault shall not be liable for a user's failure to download, store, backup or maintain access to any digital product, file or data after it has been made available.

A chargeback or payment dispute shall not automatically cancel the user's contractual obligations, nor shall it automatically create a right to continued access, refund or compensation.

5.6. Cooperation Before Disputes

Before initiating any external dispute, chargeback, payment reversal, complaint or legal action, the user agrees to contact Festinger's Vault first and provide a clear description of the issue, relevant order details and a reasonable opportunity for Festinger's Vault to investigate and propose a solution.

This clause does not prevent a consumer from exercising mandatory legal rights or contacting a competent authority where such rights cannot be restricted by law.

6. Product Support

The nature of almost all digital products means that items are provided "as is", with no implied warranty that they will function exactly as you wish or with all third party components or software etc. We are unable to provide technical support for the downloads. Third-party products provided are supported by their authors and not by Festinger's Vault or the community. Please review the support terms provided by the author of a product before purchasing it from us. Our support is limited to billing and / or technical enquiries regarding the Festinger's Vault.com website only.

7. Product Updates

Paid item updates are available to our members while their subscription is still active. Note, you can still use installed items even when your membership will ends.

8. Unauthorized/Illegal Usage

You shall not purchase search engine or other pay per click keywords (such as Google AdWords), or domain names that use Festinger Vault or Festinger's Vault trademarks and/or variations and misspellings.

Festinger's Vault Members are responsible for all content posted on forum and activity that occurs under your account.

We reserve the possibility of blocking your membership account immediately if we will know about such a not permitted behavior.

If you create an account on the Festinger's Vault website, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must immediately notify Festinger's Vault of any unauthorized uses of your account or any other breaches of security.

9. Anti-fraud

Instant downloads are available after signing up. However, all of our customers purchases can be pending for manual anti-fraud check up to review of PayPal or Stripe. You will receive a detailed email about your payment. Anti-fraud check occurs due to the growing number of fraudulent transactions from persons who are not actual cardholders of the credit cards used during purchase.

10. Price Changes

Festinger's Vault and product seller reserves the right at any time and from time to time to modify temporarily or permanently, a product prices with or without notice.

11. Links To Other Websites

Our Service may contain links to third party web sites or services that are not owned or controlled by Festinger's Vault. Festinger's Vault has also no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

If Festinger's Vault ceases, suspends, discontinues, or terminates its business operations, website, platform, marketplace, or services, whether in whole or in part and for any reason, access to memberships, downloads, updates, support, accounts, and any related digital services may end immediately from the date on which the services are discontinued.

From that moment, users shall no longer be entitled to continued access to the platform, further delivery of digital services, new downloads, product updates, support, or any other membership benefits, to the extent permitted by applicable law.

If a user has paid in advance for a membership period that can no longer be fully provided due to the discontinuation of the services, Festinger's Vault will, where required by applicable law, provide a reasonable and proportionate refund for the unused and undelivered part of the paid membership period.

No refund or compensation shall be due for services already delivered, access already provided, downloaded products, available downloads, used membership benefits, indirect damages, consequential damages, loss of data, loss of business, or loss of profits, unless mandatory applicable law provides otherwise.

Users are responsible for downloading and safeguarding any products or files available to them during their active membership. After termination or discontinuation of the services, continued access to accounts, downloads, files, updates, or user data cannot be guaranteed.

Nothing in this clause limits or excludes any rights that cannot be limited or excluded under mandatory consumer protection laws.

13. Copyright / Trademark Claims

Provider respects intellectual property rights. To send a copyright infringement notification to Provider you will need to send a written communication that includes substantially the following (please consult your legal counsel or see Section 512(c)(3) of the Digital Millennium Copyright Act to confirm these requirements):

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Provider to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
• Information reasonably sufficient to permit Provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
• A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

14. Availability

We strive to have Festinger's Vault available to you 24 hours a day, 7 days a week but you know how the internet works: occasionally you might not be able to access Festinger's Vault, and this might happen for any reason, at any time, with or without notice, or at our absolute discretion. We might also change aspects of how Festinger's Vault works, including the kinds of items available on our site. We will not be liable to you for any loss you suffer as a result of these things.

15. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Festinger's Vault its subsidiaries, affiliates, and its licensor's do not warrant that:

• The Service will function uninterrupted, secure or available at any particular time or location;
• Any errors or defects will be corrected;
• The Service is free of viruses or other harmful components;
• Or the results of using the Service/Products will meet your requirements.

We would like to take a moment to clarify that Festinger Vault is not affiliated with WP or WC in any way. While we offer a vast collection of WP themes, plugins, and tools for users to explore, download, and utilize, we operate independently from these platforms. Our services are geared towards providing valuable resources for WP users, but we do not have any official partnerships, endorsements, or sponsorships from WP, WC, or their parent company, Automattic.

16. Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. We reserve the right to change and modify terms and conditions at any time without any prior notice. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
